Welcome to Cha’s Digital Work! These Terms & Conditions outline the rules and guidelines for using my services and website. By accessing this website or engaging my services, you agree to the following terms.

1. General

• By using this website and my services, you agree to comply with all applicable laws and regulations.

• I reserve the right to update or modify these Terms & Conditions at any time without prior notice.

2. Services & Payments

• All services require full upfront payment or a 70% deposit upfront, with the remaining 30% due before the final handover.

• Payments must be completed before the final delivery of any project.

• Prices are subject to change, but confirmed quotes remain valid for the agreed-upon period.

• Failure to make the final payment may result in project delays or cancellation.

3. Revisions & Approval

• Each service includes a limited number of revisions, as outlined in the service agreement. Additional revisions may incur extra charges.

• Once the final project is approved, any further changes will be billed separately.

4. Refunds & Cancellations

• Due to the nature of digital services, all payments are non-refundable once work has begun.

• All payments made are non-refundable, including deposits and upfront payments, even if the client decides to cancel before work begins. This policy is in place to account for the time, resources, and preparation to allocated to each project.

• If a client cancels before work starts, a partial refund may be considered based on project scope and expenses incurred.

• If I am unable to complete a project due to unforeseen circumstances, a fair resolution will be discussed.

5. Client Responsibilities

• Clients must provide all necessary information, content, and materials required for the project in a timely manner.

• Delays in providing content may impact the project timeline and completion date.

• It is the client’s responsibility to review and approve all work before final delivery.

6. Late Payments & Fees

• If the remaining 30% balance is not paid within 2 days of project completion, a 10% late fee will be added.

• If the payment is not made within 7 days, work may be paused, and access to final deliverables may be restricted.

• Continuous non-payment may result in legal action or collection efforts.

7. Confidentiality

• Both parties agree to keep confidential any proprietary information shared during the project.

• Neither party will disclose confidential information to third parties without prior written consent, except as required by law.

8. Termination of Services

• Client-Initiated Termination: The client may terminate the contract with at least 48 hours’ notice before the next billing cycle. However, all payments made are non-refundable, and any work completed up to the termination date will be billed accordingly.

• Service Provider-Initiated Termination: I reserve the right to terminate the project if the client breaches these terms, fails to provide necessary materials, or does not meet payment deadlines.

9. Ownership & Copyright

• Upon full payment, clients receive full ownership of the final design and deliverables, except for any third-party assets (such as stock images, fonts, or music).

• I reserve the right to showcase completed work in my portfolio unless otherwise agreed upon.

10. Limitation of Liability & Service Disclaimers

• I am not responsible for any damages, losses, or issues resulting from the use of my services.

• Any website, video, or content created is the client’s responsibility to maintain and use correctly.

• I am not responsible for third-party software, plugins, or services that may affect the functionality of a website or digital product.

11. Force Majeure

• Neither party shall be liable for delays or failures in performance due to events beyond their reasonable control, including but not limited to natural disasters, acts of war, cyberattacks, or government regulations.

12. Governing Law

• These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms shall be resolved under the jurisdiction of the courts of the Philippines.

13. Entire Agreement

• These Terms & Conditions, along with any written proposals or agreements, constitute the entire agreement between the client and service provider, superseding all prior discussions and agreements.

14. Severability

• If any provision of these Terms & Conditions is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

15. Amendments

• Any amendments or modifications to these Terms & Conditions must be agreed upon in writing by both parties.

16. Independent Contractor Relationship

• Both parties acknowledge that this agreement does not establish any partnership, joint venture, or employment relationship.

17. Third-Party Services

• If the project involves third-party services or products, I am not responsible for their performance, quality, or reliability. Any issues arising from third-party services should be addressed with the respective providers.

18. Acceptance of Terms

• By engaging my services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
